emFONE MONITORING AGREEMENT - Terms and Conditions

Terms and conditions of Design-Com Technologies Pty. Ltd. A.B.N. 31 091 941 838

Company” refers to the organization named on form EXT_WARR.

DCT” refers to Design-Com Technologies Pty. Ltd.

Emergency Lift Telephone” refers to a telephone manufactured by DCT and installed in a lift car.

Other Telephone” refers to a telephone other than an Emergency Lift Telephone, manufactured by DCT and installed on a lift car top, in a lift pit or in a machine room, and which is networked with an Emergency Lift Telephone.

Telephones” refers to a network of Emergency Lift Telephones and Other Telephones located within the one building.

1. The Company will enable the monitoring feature on Emergency Lift Telephones for which it requires DCT to monitor functionality and reliability, and will ensure that the reporting frequency is configured to report every third day (i.e. as prescribed by the EN81-28 Code) or, if the Company so elects, more frequently.

2. The Company will also enable the monitoring feature on Other Telephones for which it requires DCT to monitor functionality and reliability, and will ensure that the reporting frequency is configured to report every third day or, if the Company so elects, more frequently.

3. The Company is responsible for providing and maintaining external telephone line access for the Telephone system (e.g. generally one line per building).

4. The Company will bear the call costs of the Telephones reporting to DCT’s Communication Centre. These calls are at Local Call Rates from anywhere in Australia and will be directly billed to the Company by its communications service provider. (Note : In the case of DCT’s emFone LX-8 system, if the LX-8/M master unit is configured with monitoring enabled this unit communicates automatically with all connected Telephones.  The LX-8/M acts as the conduit to report to the Communications Centre the status of all connected Telephones.)

5. DCT will provide the equipment and expertise to remotely monitor the Telephones for functionality and reliability. Upon detection of a fault DCT’s Communication Centre will automatically send details of the fault via email to a nominated email address. Monthly reports will also be sent to a nominated email address.

6. DCT will provide an ongoing Warranty on all Telephones included in this Monitoring Agreement for the duration of this Monitoring Agreement ;

  • Warranty commences when full payment for the monitoring of the relevant Emergency Lift Telephone is received by DCT.
  • Warranty is on a “back-to-base” (Melbourne) basis. The Company shall bear the costs of any removal from site of a faulty Telephone, freight to/from DCT, and/or re-installation of a repaired or replacement Telephone.

  • DCT will repair a faulty Telephone or, at its discretion, provide a replacement Telephone.

  • Warranty exclusions are: damage caused by flood, earthquake, vandalism, corrosion, battery leakage, power surge (including lightning), impact and obvious misuse

7. As of 1 st January 2012 the monitoring charge is 70 cents +GST per week (i.e. $36.50 +GST per annum) for each Emergency Lift Telephone. The monitoring charge is payable by the Company annually in advance. The monitoring charge will be reviewed by DCT annually and may be adjusted following such review. Other Telephones will be monitored free of charge.

8. The Company may terminate this Monitoring Agreement at any time in writing and without penalty for termination, but no refund will be given for any prepaid and remaining monitoring term.

9. DCT may terminate this Monitoring Agreement upon giving 12 months notice in writing.

10. DCT may cease to monitor all Telephones and the Warranties may be cancelled if full payment for the monitoring of the relevant Emergency Lift Telephones is not received by DCT within 3 months of the due date.

11. The extended Warranty associated with the Monitoring Agreement does not override or alter the Company’s statutory rights, or affect DCT’s responsibility to meet statutory conditions and statutory warranties.

12. Previously installed Telephones may also participate in a Monitoring Agreement, however a warranty claim under the associated extended Warranty is subject to a minimum of 30 days prior monitoring history.

13. As an additional benefit to the Company, DCT will trade an old lift telephone for a new Emergency Lift Telephone

  • The old unit can be a lift telephone from any manufacturer.
  • The Company shall bear any removal, freight, installation or other costs associated with the change-over.
  • DCT will issue a trade in credit note for $150 +GST after :
    • the new Emergency Lift Telephone is installed and reports to the Communication Centre, and
    • the old unit is returned to DCT.
